For speeding last month, My only arguement regards the accuracy of the radar gun and whether or not the cop calibrated the gun before and after with a calibrated tuning fork and or calibrated speedometer(instead of me trying to prove that I wasn't speeding, the state has to prove that I really WAS speeding?). I'm hoping that one of the records is expired. I got the ticket on 8/30, so if its up to date, then it should be within 2/28-8/30 if not, I win. If the radar gun, tuning fork, and speedometer have been calibrated within 6 months, my next arguement is gonna be whether or not the cop used the radar gun, tuning fork, and speedometer on the records provided. Suggestions?

Draw the judge a diagram. My evidence prof (who does traffic court at times) says she likes to see a diagram whenever it might help. :mhihi:

:werd: Without a motion for discovery prior, the officer/department is not required to bring any of their records (at least not here in MA). And remember, if the officer says he "calibrated the radar gun with the tuning forks" ask him how that is possible since (a) it can't be done with tuning forks, and (b) unless he's a certified radar technician, he shouldn't be calibrating anything. All the tuning forks allow you to do is *check* the current calibration of the radar gun to make sure it is accurate. *Calibrating* the gun is the act of making it accurate, which an officer cannot do. Sure it's semantics, but Sal (and Pickles and the rest of the LPR phegs) will tell you that semantics can go a long way in court.
Also, ask the officer to explain what a tracking history is, the three components to it, and what he did in your particular case for the three components.

The cop also used a handheld radar gun...I dont know if that helps

You can use that argument, but again, without prior discovery requests you can't just land that on them at the hearing....adversarial due process and all that jazz.....
I would try and plea with the prosecuting DA and get a few points/bucks knocked off.....you most likely are fucked with the discovery pleading with how soon the hearing is.

Springfield...I got Fuxored by lidar...my whole defense went out the window when the cop said that shit. $40 fine + $57 court fees = $97 -4 points FTW! I also met a hot blonde attorney that I didnt go to dinner with tonight...If they didnt prohibit camera phones you guys would be have been pleased.

It should have been marked on the damn citation. BTW, I use the lidar to shave in the cruiser. The laser beam gives me a nice close shave.
